Terms of Service

You must be at least 18 years old and able to form a binding contract. If you use our services on behalf of a business, you confirm you are authorized to bind that business to these Terms. Our services are intended for business use.

We provide automated customer communication tools for businesses, including missed-call text-back, owner alerts, review requests, lead follow-up, and related services, depending on the plan you choose. Features, availability, and setup timelines may change. Setup typically takes a few business days because phone numbers must be registered with and approved by telecommunications carriers, which we do not control.

Program description: If you consent on our website, Make My VA will send you text messages about your inquiry and our services and, if you separately opt in, occasional tips, offers, and product updates.

• Reply STOP to cancel at any time. You will receive one confirmation message, and no further messages unless you opt in again.

• Carriers are not liable for delayed or undelivered messages.
• Consent to receive messages is not a condition of purchase.

If you use our services to communicate with your own customers, you are the sender of those communications and you are responsible for complying with all applicable laws, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, state telemarketing and messaging laws, and carrier and industry messaging rules. You agree to:

• Obtain and keep records of any consent the law requires before messaging your customers.
• Honor opt-out requests promptly and respect quiet hours and other timing restrictions that apply in your customers' states.
• Provide accurate business information for carrier registration.
• Not send unlawful, deceptive, harassing, hateful, or sexually explicit content, or content that promotes prohibited products or services.
• Not use the services to send unsolicited bulk messages, or to attempt to bypass carrier filtering or registration requirements.

We may suspend or terminate service that violates these Terms, carrier rules, or the law.

The AI Front Desk plan is $297 per month, billed in advance. It is month-to-month: you may cancel at any time, and cancellation takes effect at the end of the current billing period. A one-time setup fee covers phone number registration and onboarding; the setup fee is waived for sign-ups through October 31, 2026 and is $297 after that. You authorize us to charge your payment method for all applicable fees and taxes.

Fair use: Unlimited AI-answered calls are intended for normal use by a single business location. If your usage is unusually high or appears automated or abusive, Make My VA may contact you to discuss a different arrangement.

We may provide a phone number for use with the services. Where we offer number porting, it is subject to carrier approval and timelines we do not control. On cancellation, a number we provided may be released, unless you arrange in advance to port it out where possible.

Our services rely on third-party providers, including hosting, software, payment, and telecommunications providers. We are not responsible for their acts or omissions, outages, or changes to their services, pricing, or rules.

The website, services, and their content are owned by us or our licensors and are protected by law. You may not copy, modify, resell, or reverse engineer them except as these Terms permit. You keep ownership of the content and data you provide, and you grant us the rights needed to provide the services.

THE WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that messages will be delivered, that the services will be uninterrupted or error-free, or that you will achieve any particular business result.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE THREE MONTHS BEFORE THE CLAIM AROSE. Some states do not allow certain limitations, so some of these may not apply to you.

You agree to defend, indemnify, and hold us harmless from claims, losses, and expenses, including reasonable attorneys' fees, arising from your use of the services, your communications with your customers, or your violation of these Terms or the law.

You may stop using the services at any time. We may suspend or terminate access if you violate these Terms, fail to pay, or if required by a carrier or by law. Sections that by their nature should survive termination will survive.

These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Connecticut, and you consent to their jurisdiction.

We may update these Terms from time to time. We will post the updated version on this page with a new effective date. Continued use after changes take effect means you accept the updated Terms.
